Citizenship of the RSA Litvaks represented by GLIMSTEDT has been restored2016-12-23

Taking into account the provision of the Migration Department, the Minister of the Interior of the Republic of Lithuania has ordered to restore the citizenship of the Republic of Lithuania of the two RSA Litvaks, who in administrative case regarding restoration of the citizenship of the Republic of Lithuania were represented by associate partner attorney-at-law Solveiga Palevičienė and associate partner attorney-at-law Inga Klimašauskienė of the law firm GLIMSTEDT.

Battle of the two RSA Litvaks, the claimant and his Lithuanian-born mother over the restoration of the citizenship of the Republic of Lithuania started in the beginning of February 2016. The first instance court, having heard the administrative case, has dismissed the claim of the RSA Litvaks as ungrounded, having stated that the departure of the claimant’s mother from Lithuania shall not be treated as leaving, because the reasons for departure from Lithuania before 1940, as indicated by them, are allegedly not related to special reasons, allowing to assess the departure as an exceptional one.

However, on 19 July this year, the judicial panel of the Supreme Administrative Court of Lithuania satisfied the claim requesting to annul the decision of the Ministry of the Interior of the Republic of Lithuania to refuse to satisfy the requests for restoration of the citizenship of the Republic of Lithuania, and ordered the ministry to re-examine the Litvaks’ requests regarding restoration of the dual citizenship properly.
