The Estonian Supreme Court’s judgement of the 5th November 2007 answers whether the Law of Obligations Act gives the injured party the right to demand compensation directly from an insurer that has concluded a voluntary liability insurance contract with the policyholder causing damages to the injured party. The litigation and arbitration department of Glimstedt headed by partner Marko Tiiman successfully represented the insurer, ERGO Kindlustuse Ltd.

We are happy to announce that our partner and the head of Taxation Practice Group, Mr Priit Lätt was elected Member of the Advisory Board acting under Estonian Taxpayers Association together with the former Ministers of Finance, Mr Aivar Sõerd and Mr Taavi Veskimägi.

The Shell Group recently completed a transaction with OÜ Pisipehme (a member of the Jungent Group of companies) that will see OÜ Pisipehme become a distributor of Shell-branded lubricants in Estonia, Latvia and Lithuania. The pan-Baltic transaction also involved the purchase by OÜ Pisipehme of the shares of Shell Eesti AS, Shell SIA and Shell Lietuva UAB.

Glimstedt's offices in Riga, Tallinn and Vilnius advised the Shell Group on this transaction.

In its judgment of 13th June 2007 (AS Tallinnfilm vs Northern Tax and Customs Centre of the Estonian Tax and Customs Board) the Supreme Court of Estonia resolved the question whether a taxable person has a right to file a claim for refund in case he was not filed a claim for interest after 5th November 2002, but he paid interests voluntarily, including based on decision of paying tax arrears in instalments. Glimstedt Straus & Partners advised the equity owners of Estonian leading travel agent Horizon Travel Ltd on selling their stake to the biggest Finnish travel agency Aurinkomatkat-Suntours OY.

Glimstedt Straus & Partners advised Eastern Europe Real Estate Investment Trust Ltd. (EEREIT) in legal issues of acquisition of immovable and production facilities in Tallinn from Swedish metal company Svets & Mekanogruppen AB`s affiliated company Finmec Ltd. as well as concluding a sale and leaseback deal. EEREIT has real estate investments in Estonia, Latvia, Lithuania, Poland and Bulgaria.
