In the presented claim the plaintiff asked the Court to declare unlawful the disclosure of incorrect information by the defendant which was published in an article “Ravimitootja võitleb Oviiri määruse vastu" in the newspaper Eesti Päevaleht on the 10-th of October 2002. The plaintiff also requested to declare unlawful the disclosure of incorrect information to a news service agency BNS in the press release from 16-th of October 2002.

On the 7th of June the Circuit Court of Tallinn refused a request of Elion Enterprises Ltd (hereinafter Elion) to suspend the compliance with the precepts of the Estonian National Communications Board. The court found that in given matters the Elion’s interest to suspend the compliance with the precepts didn’t outweigh the public interest and interest of competitors for the immediate compliance with the precepts.

On the 10th of June 2005 Civil Chamber of the Supreme Court has made a decision in the case AS Sanwood v AS Eesti Mereagentuur, where the Supreme Court treated the liability of the carrier of merchant shipping for the first time in its practice.

On 6 May 2005, the plenary session of the criminal chamber of the Supreme Court issued a long-awaited decision regarding copyright law. The plaintiff in the case was represented by Straus & Partners before the Supreme Court.

Supreme Court has for the first time in its judicial practice rendered legal opinion on a relationship existing between a company and a member of the management board. Legal relationship between a company and a member of the management board is a legal relationship under the law of obligations that similar to contract and both of the parties of that relationship have the rights and obligations on the basis of contract law. The provisions of Law of Obligations Act (“Võlaõigusseadus”) for the authorization agreement can be applied for this relationship.
